Why Don’t Some Employees Report Harassment?

May 27, 2021 Legal Team

We know that sexual harassment is a significant problem in many workplaces. Unfortunately, several employees experience harassment, but they don’t report it. Instead, they may hope that it will go away and pass without any further issues. In many cases, though, many employees don’t report harassment because they are worried or afraid.

One of the biggest fears is retaliation. We’ll explain more below.

Fear of Retaliation

Some employees don’t report sexual harassment because the aggressor is a supervisor or employer. They fear that the employer or supervisor will retaliate against them. Retaliation often leads to uncomfortable workspaces — sometimes even preventing someone from completing their daily tasks.

What is Retaliation?

Retaliation can occur in numerous forms, including the following:

  • Encouraging bullying or dangerous work environments
  • Demoting someone from their current position
  • Firing an employee after they’ve reported an illegal practice

Some people may attempt to use intimidation when they sexually harass someone else. If your employer or supervisor tells you that you would be fired for reporting sexual harassment, know that you have rights that protect you from retaliation.

Your Rights as a California Employee

California law protects you if your supervisor threatens you with retaliation or if your employer fires you for reporting wrongdoing. In fact, if you are the victim of retaliation, you can work with a lawyer to safeguard your rights and hold the harasser accountable for their actions.

You should never be afraid to report sexual harassment. When you report harassment, you can help yourself in your current situation. Even more, you can help prevent others from experiencing the same actions and same concerns.
