Simon Kwak is an associate attorney with Aegis Law Firm. He focuses his practice on wage and hour class action and collective action cases representing employees with claims under California and federal law.
Prior to joining Aegis, Mr. Kwak worked as a law clerk with a plaintiff-side employment litigation firm while awaiting the results of the California Bar Exam and subsequently as an associate attorney with a general practice firm in Orange County, California. In this capacity, Mr. Kwak represented and advised both employees and local businesses in connection with labor and employment claims, including age discrimination, sexual harassment, retaliation, wrongful termination, employee misclassification, unpaid minimum and overtime wages, reimbursement of business expenses, lawful meal and rest breaks, wage statement violations, and labor collective bargaining procedures. Mr. Kwak represented clients in mediation proceedings, administrative proceedings before the California Division of Labor Standards and Enforcement (California Labor Commissioner) hearings, California state court proceedings, United States National Labor Relations Board (NLRB) unfair labor practice investigations, and investigations by the Wage and Hour Division of the United States Department of Labor.
Mr. Kwak also has experience working on complex litigation matters involving multi-party and class action cases, choice of law, breach of contract, business tort, shareholder dilution and minority shareholder oppression, and commercial real estate disputes. As part of his representation of commercial real estate investment companies, Mr. Kwak helped manage litigation proceedings across multiple jurisdictions through the engagement of local counsel. In addition to his litigation experience, Mr. Kwak worked as a transactional attorney on various business dealings such as the negotiation and preparation of contracts concerning commercial real estate leasing and purchase and sale agreements, commercial asset purchase agreements, articles of incorporation, limited liability company operating agreements, corporate stock and limited liability member buyout agreements, and dispute settlement agreements.
While attending law school, Mr. Kwak was first introduced to the field of employment law as a law clerk with an employment litigation firm where he assisted attorneys throughout pre-filing and pre-trial proceedings. During his final semester of law school, Mr. Kwak participated in the Pepperdine School of Law’s Washington, D.C., Externship Program where he took advanced legal writing courses while serving as an extern for a DC-based non-profit organization that advocates on behalf of racial and ethnic minorities before the Federal Communications Commission.
At Aegis, Mr. Kwak brings a unique and diverse legal background in representing and protecting California employees who have been subject to illegal employment practices.
Mr. Kwak earned his B.A. in Political Science and Economics from the University of California at San Diego in 2008, and he earned his J.D. from Pepperdine University School of Law in 2013.
